1.0. This license agreement is for the software product commonly known as CalMAN, a display calibration software product. Permission is granted to use this software to perform image calibration that belongs to a single user for non-commercial purposes only. Use of this software for a commercial purpose or for displays not owned by the licensee is strictly prohibited. A commercial use license is available from the licensor on a case-by-case basis.

1.1. Ownership. You acknowledge that SpectraCal, LLC, or its licensors, own all rights in the Licensed Software, Documentation, Tools and Implied Methods described in the software. Other products required to be used in conjunction with the CalMAN Software are the property of their respective owners and may be protected by other licensing agreements, and by applicable copyright or other law.

1.2. Protection of the Source Code. As delivered, the software contains all of the necessary calculations and computations to properly calibrate a display. You agree that you are prohibited from dissassembling, decompiling or reverse engineering, in any way, the functionality contained within the software. You further agree not to duplicate, replicate or otherwise transfer any part of the source code, object code or any other electronic version of the tool to another product, whether commercial or not, for subsequent distribution to third parties or for any other purposes.

1.3. Transference. The user agrees not to transfer the software in any form or fashion that conveys partial or full access to the underlying functionality of the software while still retaining the same for him or herself. Should the user do this, by willful act or accident, then the user’s license rights are terminated for all copies of the software in his or her possession. The licensee is allowed to sell the rights to his or her license to a third party, provided all tied hardware (see 1.5, below) is included as part of the sale, unless such conveyance is strictly prohibited by prior arrangement or licensure agreement.

1.4. Printing and Output. The licensee is authorized to create and store “printouts” or other form of output or savefile, either on paper or in an electronic fashion. Where any such authorized printout is made, either electronic or physical, all coyright notices of the author must be maintained intact, in their original form.

1.5. Hardware Tie-In. The software is licensed to the licensee based upon his or her ownership of a specific meter or U3-enabled flash drive. Such election is at the option of the user only at the point of upgrading from a prior version of CalMAN. New licensees of CalMAN are required to have a U3 flash drive. Use of the software while not in ownership of ALL HARDWARE TIED TO A LICENSE is a violation of this agreement.

2.0. Termination. This License is effective until terminated. You may terminate this license at any time by destroying the Licensed Software and Documentation, and any and all copies thereof, including partial copies. This License will also terminate automatically without notice from SpectraCal, LLC, if you fail to comply with any provision of this License. Upon termination, all rights granted under this License shall terminate, and all complete and partial copies of the Licensed Software and Documentation must be destroyed.

3.0. No Warranty. THE LICENSED SOFTWARE AND DOCUMENTATION ARE PROVIDED ON AN "AS IS" BASIS. NEITHER SPECTRACAL, LLC, NOR ITS PRINCIPALS OR EMPLOYEES WARRANT THAT THE FUNCTIONS CONTAINED IN THE LICENSED SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT THE OPERATION OF THE LICENSED SOFTWARE WILL BE UNINTERRUPTED, ERROR FREE, VIRUS-FREE, OR THAT DEFECTS IN THE LICENSED SOFTWARE WILL BE CORRECTED. THE LICENSOR EXPLICITLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SHOULD THE LICENSED SOFTWARE OR DOCUMENTATION PROVE DEFECTIVE, THE LICENSEE (YOU) ASSUME THE ENTIRE COST OF ANY AND ALL NECESSARY SERVICING, REPAIR OR REMEDIATION MEASURES THAT MAY BE REQUIRED FROM HAVING USED OR RELIED ON ANY PART OF THIS PRODUCT OR ITS RELATED SUPPORT INFRASTRUCTURE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF THE LICENSED SOFTWARE IS

3.1 CalMAN is a product geared to aid people in enjoying their investment in television, a luxury. You agree that there is no compulsion, coercion or other means of force that is causing you to want to use this product. If there is, then your recourse is against such parties as are oppressing you. SpectraCal, LLC, recommends contacting the appropriate authorities under such circumstances.

4.0. Limitation of Liability. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER CONTRACT, TORT, OR OTHERWISE, SHALL SPECTRACAL, LLC, OR ITS PRINCIPALS OR EMPLOYEES BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR EXEMPLARY DAMAGES SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE OR ANTICIPATED PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER ECONOMIC LOSS ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, EVEN IF EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY REMEDY SET FORTH IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.

5.0. Governing Law. This License shall be interpreted, construed, and enforced in accordance with the laws of the State of Washington.

5.1. Severability. In the event that one clause, section or portion of this EULA is deemed unenforceable, void or negated by a court of law, that shall have no bearing on the vlaidity, enforceability or duration of the remaining clauses.

6.0. No Other Agreement. This License constitutes the entire agreement between the parties relating to the Licensed Software and Documentation and supersedes any proposal or prior agreement, oral or written, and any other communication relating to the subject matter of this License. If any provision of this License is held to be unenforceable in any respect, such provision shall be reformed only to the extent necessary to make it enforceable.

7.0. Acknowledgment. You acknowledge that you have read this License, understand it, and agree to be bound by its terms and conditions. If you do not agree to the terms of this agreement, then your license right is terminated, and you must destroy the licensed software and documentation.

CalMAN HTPC Pattern Generator 1.2 did it all

The CalMAN HTPC Pattern Generator 1.2 did all I expected and even more with the different screen options. It would be good if I could easily convert its output and put it on a DVD so I could makeup my own DVD test disk to what I want. Generate a avi or mpg file and even a widescreen mpg file would be great. The next step would be a a High Def 1080 output as well. Both PAL and NTSC.
